Notice of The Office of The State Council Work Safety Committee on Doing A Good Job in Closing Non Coal Mines Without Safety Production Conditions

Each province, autonomous region, municipality directly under the central government, and Xinjiang Production and Construction Corps Work Safety Committee, as well as relevant member units of the State Council Work Safety Committee:

 To ensure the completion of the task of closing over 1000 non coal mines (including tailings ponds) that do not meet safety production conditions in 2019, we hereby notify the relevant matters regarding the closure of non coal mines that do not meet safety production conditions as follows:

1、 Close Object

Non coal mines that meet one of the following conditions shall be included in the scope of key closure:

（1） Those who are ordered to stop production and rectify major production safety hazards in accordance with the law, fail to rectify within the prescribed time limit, or still fail to meet the statutory safety production conditions after rectification.

（2） Violation of the "three simultaneities" regulations for construction project safety facilities, refusal to comply with safety supervision instructions, and failure to complete relevant procedures within the prescribed time limit.

（3） The safety production conditions of metal and non-metallic mines co occurring with coal cannot meet the requirements of national or industry standards for coal mines.

（4） The minimum distance between the mining areas of adjacent small open-pit quarries is less than 300 meters.

（5） Tailings ponds that have reached the final design elevation or are no longer undergoing tailing operations.

2、 Close standard

（1） Revocation or cancellation of mining licenses, safety production licenses, industrial and commercial business licenses, and other related certificates.

（2） Dismantle facilities and equipment directly used for production, such as power supply, water supply, ventilation, lifting, and transportation.

（3） Underground mines need to be bombed or filled with mine shafts, open-pit mines need to complete slope treatment, and tailings ponds need to be closed for treatment and announced for cancellation.

（4） Set up clear warning signs on the surface.

（5） Clean up and confiscate civilian explosives and hazardous chemicals retained in mines.

3、 Close program

（1） Confirm to close the object.

Urge local people's governments at or above the county level to organize a comprehensive investigation of non coal mines within their jurisdiction, study and determine the list of non coal mines to be closed, and announce it to the public on major local media, accepting social supervision.

（2） Implement closure in accordance with the law.

Urge local people's governments at or above the county level to organize relevant departments and enterprises to implement closure measures in accordance with the closure standards.

（3） Strictly inspect and accept.

Urge local people's governments at or above the county level to organize relevant departments to conduct inspections and acceptance in accordance with the closure standards.

4、 Job requirements

（1） Improve ideological awareness and take proactive actions.

All regions should fully recognize the important significance of closing non coal mines that do not meet safety production conditions for preventing and resolving major safety risks, curbing the occurrence of major accidents, and promoting the continuous and stable improvement of safety production situation in non coal mines. They should further enhance their sense of responsibility and mission, take effective measures to do a good job in closing non coal mines that do not meet safety production conditions.

（2） Clarify work objectives and implement them in accordance with laws and regulations.

Each region should scientifically and reasonably determine the closure plan based on the number of non coal mines nationwide and the closure work goals, combined with the number and distribution of non coal mines in the local area, and decompose the target tasks step by step to implement them in each city (state, league), county (district, banner). We should urge local people's governments at the city and county levels to strictly follow the closure procedures and standards to implement closure tasks, and organize and implement them in accordance with laws and regulations.

（3） Strengthen communication and coordination to form a working synergy.

Each region should improve the coordination and linkage mechanism under the unified leadership of the government and the participation of relevant departments, refine and implement the responsibilities of each relevant department, strengthen communication and cooperation, form a working force, timely study and coordinate the resolution of key and difficult issues, and ensure the smooth progress of the closure work.

（4） Strictly supervise and inspect to ensure completion of tasks.

Each region should strengthen supervision and guidance, regularly schedule and close work progress, and promptly supervise and solve major problems in work. For areas where responsibilities are not fully implemented, work is not carried out effectively, and tasks cannot be completed on schedule, timely measures such as interviews and criticism should be taken to supervise implementation. We need to strengthen law enforcement inspections on closed objects to prevent production safety accidents caused by sudden production and production exceeding capacity, intensity, and staffing before closure, and to prevent the resurgence of closed mines.
